can i format the hard disk with out deleting some files. otherwise any software is there for that...

no. Formatting a hard drive removes all data.

But ofcourse you can move those files to some other drive, then format the drive and finally restore the files back. But what is your actual problem ?

There is a way to do a partial format but it is really not recommended. Move the files, reformat then but the files back. Trust me, it's easier.
